Rental Terms & Conditions

1. Reservations and Confirmations

  1. These Terms and Conditions apply to lodging and services provided through Alabama Getaways INC (AG). AG reserves the right to modify these Terms and Conditions at any time by posting on the Terms and Conditions page of the AG website. The property where you stay (private home, condominium, or other property) is referred to as the Home, and any person occupying the Home is referred to as a Guest.
  2. The person signing the Rental Agreement is the Primary Guest. The Primary Guest must be at least 25 years of age and must be a member of the group staying at the Home. The Primary Guest is responsible for informing all Guests and visitors of these Terms and Conditions, and the Primary Guest is responsible for the actions of all Guests in the party and visitors. For legal and accounting purposes, the person placing the reservation must be the same as the credit/debit card holder,or listed as an additional guest and a photocopy of their Government Issued ID provided. Reservations made under false pretenses are subject to cancellation and/or eviction with forfeiture of all funds paid.

2. Confirming a Reservation

  1.  AG will not confirm reservations until it has received the required deposit and the Primary Guest has signed the Rental Agreement.
  2. To confirm a reservation, the Guest must pay a deposit equal to 25% of the total reservation cost (unless specifically agreed otherwise) and provide the signed Rental Agreement within 24 hours after the Rental Agreement is received.
  3. Properties with four bedrooms or more: The remaining balance of the total cost is due 60 days prior to arrival for all properties with 4 bedrooms or more.  Reservations made within 60 days of arrival require full payment at the time of reservation.
  4. Properties with three bedrooms or less: The remaining balance of the total cost is due 30 days prior to arrival for all properties with 3 bedrooms or less.  Reservations made within 30 days of arrival require full payment at the time of reservation.
  5. AG may cancel any reservation that does not comply with these requirements.
  6. Prices and availability are subject to change until the reservation is confirmed.
  7. Once confirmed, the specific Home and dates you reserve are guaranteed. If an unforeseen circumstance causes the Home to be uninhabitable, AG reserves the right to substitute or refund all funds paid by the Guest immediately. If substituted, the home to be of equal or greater value.
  8. AG may cancel or refuse to accept any reservation if any Guest in the party has previously breached the AG Terms and Conditions.
  9. All special requests must be communicated directly to AG Staff. Any verbal communications must be confirmed by e-mail or text. Undocumented requests may not be fulfilled.
  10. Vacation Home Rentals are subject to applicable resort fees, sales tax, and

lodging taxes which may be subject to change without notice. Lodging Quotes shown are inclusive of rent, cleaning fees, and resort fees.

  1.  Accidental Vacation Rental Damage Coverage (AVRDC), required for and included in all reservations. AVRDC provides Guests with coverage for accidental damage that occurs during the stay. AVRDC does not cover intentional damage, damage caused by a pet, or by careless actions such as allowing unsupervised children to use an elevator; or disobeying other provided house rules. Guests will be liable and charged for damage to the Home and contents occurring during the stay that is not covered by AVRDC.

 

3. Check-In / Check-Out

  1. Check-in time for ALL Homes is from 4:00 pm and check-out is by 10:00 am. Requests for early check-ins or late check-outs are strictly subject to availability and may only be approved the day before arrival/departure.
  2. The Group Leader must notify AG if the first party to check-in will not be the Group Leader. Failure to do so may result in delay or refusal of check-in for that person.
  3. Guests will be provided detailed check-in instructions prior to arrival. Check-in and access to the Home require:
    * Payment in full.
    * Signed rental agreement.
    * Guest verification and guest payment verification using a valid government-issued photo ID.
    * A credit card to be kept on file to which any amounts payable by Guests may be charged.
  4. Homes are inspected after every stay, and additional cleaning charges will be imposed if the Home is not left in a reasonable condition and extraordinary cleaning is required. Guest check out requirements:

* Windows and doors must be left closed and locked.
* All trash must be removed from the property and disposed of in the proper trash areas (trash chutes or outdoor trash cans/bins). Please ask if you need help locating.
* Dishes must be washed and put away or left clean in the dishwasher.
* Used towels are to be left in the bathtub or shower.
* Garage doors (if applicable) must be left closed.
* Furniture must be in its original location.
* All keys and garage door openers (if any) placed on the kitchen counter

4. Cancellation and Refunds 

  1. Notification to AG in writing (e-mail) is required for the Guest to cancel anyReservation. Guests with confirmed reservations who desire to change Homes, regardless of reason, must cancel the original reservation pursuant to the cancellation policy, and a new reservation must be made at the alternate Home, which reservation is also subject to the cancellation policy.
  2. Cancelations for Homes with 4 bedrooms or more: Cancellations made 60 days or more from arrival date for all properties with 4 bedrooms or more  will receive a full refund less a $50 cancellation fee to cover admin costs. Cancellations made 59 days or less from arrival date are non-refundable unless we are able to re-rent the property. If property is re-rented, Guest will be refunded any funds AG is able to re-coup less fees.
  3. Cancelations for Homes with 3 bedrooms or less: Cancellations made 30 days or more from arrival date for all properties with 3 bedrooms or less  will receive a full refund less a $50 cancellation fee to cover admin costs. Cancellations made 29 days or less from arrival date are non-refundable unless we are able to re-rent the property. If property is re-rented, Guest will be refunded any funds AG is able to re-coup less fees.
  4. AG highly recommends that Guests purchase travel insurance in the event you have to cancel your reservation. Please contact us for more information.
  5. Full refunds are given if a mandatory evacuation is issued for the area, or if a property goes out of service for any reason and a replacement property is not available.
  6. There are no full or partial refunds for late arrivals or early departures.

5. General Terms and Conditions

 

During the stay, the Guest’s 24-hour phone/text contact is ALABAMA GETAWAY:

251-230-2910. For after-hours emergencies, please text the above number and also please telephone the AG office (251-202-3211) and follow the instructions to leave a message.

  1. Travel to and outdoor and indoor activities in beach areas during any time of year involve risks that Guests must make themselves aware of. Potential risks include, without limitation, those associated with slippery conditions, those associated with swimming in pools or the Gulf of Mexico, those associated with Rip Tide currents, those associated with inclement weather. Guests waive and release and agree to hold harmless and indemnify AG and the Homeowner against any and all claims, actions, and damages (claims) arising from any cause during their stay, including out of activities they participate in during their stay, including, without limitation, personal injury, property damage, expenses, judgments, fines, settlements and other amounts resulting from the Guest stay, other than claims arising from the gross negligence of AG, its agent or employee.
  2. Not all Homes are equipped with a safe. AG is not responsible for Guests’ property. Please consider leaving valuables at home.
  3. Quiet time in all locations is from 9 pm to 7 am. Many Homes are in residential communities or buildings and any violations of municipal noise or disturbance ordinances may result in citations and fines, which are the sole responsibility of the Guests. AG may immediately terminate the stay of any Guest causing unreasonable noise and disturbance and retain all amounts paid. No events / parties / weddings / DJs or Bands with amplified sound are permitted, and this will be strictly enforced.
  4. Smoking and vaping are not permitted in any part of the homr, including on decks, balconies, or porches and within 100 feet of entrances. Decontamination and littering charges starting at $500 per day will be assessed.
  5. All Guests agree that they shall not, and will ensure that any visitor of any Guest shall not, record, film, video, or in any other way document any sort of media production for broadcasting or public use in any format in the Home they have reserved, unless the Guest(s) and/or visitor has received prior express written consent of AG, which consent may be withheld in its sole discretion.
  6. AG standard housekeeping service is included with the lodging rate. Standard housekeeping includes an exit clean, based upon the Home being left in a reasonable condition (see 3d).
  7. Luggage carts are not allowed inside any property. They cause damage to walls and flooring. Guests will be responsible for any additional cleaning charges or damage resulting from luggage carts.
  8. Guests and visitors shall act responsibly and respectfully toward other Guests, AG staff, and community members. AG will take appropriate and immediate action in response to complaints or knowledge of violations of its policy. AG may immediately terminate the stay and retain all amounts paid if, at any time during the stay, a Guest or visitor acts in a dangerous, unruly, or malicious manner, including verbal or physical abuse.
  9. Use of illegal drugs in the Home is prohibited and may result in immediate termination of the stay with AG retaining all amounts paid.
  10. AG and its employees are not responsible for underage consumption of alcohol or drugs by Guests or visitors, Guests or visitors driving while intoxicated, or any accidents involving Guests or visitors.
  11. Equipment in the Home may require service or repair from time to time, and AG will attempt to facilitate this as soon as possible. No refunds or credits are provided if equipment or amenities are out of service.
  12. AG cannot guarantee that community or condo amenities outside the home will be available during your stay. No refunds or credits are provided if community or condo equipment or amenities are out of service.
  13. Exclusive jurisdiction and venue for any legal proceedings between Guests and AG or involving these Terms and Conditions shall be in Baldwin County, AL.
  14. Events at the Home with the number of guests exceeding the occupancy limit at the Home is prohibited and can result in eviction and forfeiture of monies paid.
  15. In addition to the terms listed here, Guests are expected to review and obey any rules posted or provided for the Home,  Home’s community or Home’s condo development (if applicable). Failure to do so can can result in eviction and forfeiture of monies paid.
  16. Throwing or dropping items from decks or balconies is very dangerous and strictly prohibited and can result in eviction and forfeiture of monies paid.
  17. Coastal areas have speciality plumbing systems. ONLY toilet paper can be flushed down the toilet. NO OTHER products or there is risk for severe issues with grinder pumps and other sewage systems. Each Home is stocked with a plunger in the even you have a clog.
  18. Linens and towels are the property of AG. These items are not to leave the Home or be used for beach towels at the beach or by the pool.
  19. Sand can lead to issues for pool systems and bath/shower drains. Please wash all sand off yourself and any items before entering the condo.

6. Pets

  1. Pets are prohibited at all properties except for our designated ‘Pet Friendly’ properties.
  2. Service animals, as defined pursuant to regulations under the Americans with Disabilities Act, are allowed to accompany Guests during their stay. Service animals must be individually trained to perform a task for the benefit of an individual with a disability. Animals providing emotional support, comfort or companionship are not service animals. Guests must notify AG at the time of reservation if they will be bringing a service animal. Service animals may be removed if they are disruptive, aggressive, or not housebroken. Under Alabama law, it is a criminal offense to misrepresent an animal as a service animal.

7. Bunk Bed Safety Warnings

There are certain risks associated with using a bunk bed and bunk bed ladder,

and Guests, on behalf of themselves and any minor children, agree that using the bunkbed and/or the bunk bed ladder is at the sole risk of the user. AG and the Homeowner assume no responsibility for loss, injury, death, damage, or illness resulting from use of the bunk bed and/or ladder and Guest agrees to hold AG and the Homeowner harmless  and with no fault whatsoever for any guest use of the bunk bed and/or ladder. While not an exhaustive list of precautions, Guests agree to follow these industry standards:  1) Use of top bunk is limited to occupants six years old or older; 2) Use of the top bunk is limited to 1 occupant and a maximum 175 lb weight; 3) No jumping or other horseplay on or around the bunk bed or ladder; 4) Always use the ladder for entering and leaving the upper bunk.

 

8. Right of entry

Guest(s) agree that reserves the right to enter the rental property any time to investigate disturbances, check occupancy, check for damage, to make such repairs, alterations or improvements as we may deem appropriate.

 

9. Upon arrival

If there are concerns or issues with your rental property, please immediately contact our office by phone or text (leave a message if there is no answer). We can typically correct any issue same day or the next morning.

 

10 . Indemnification & hold harmless

While and its property owners strive to maintain vacation properties in the finest condition, no guarantees are expressed nor implied regarding suitability or for any particular purpose. All guest(s) and their invitees use the vacation property structures and premises at their own risk. and its property owners shall not be held liable or otherwise responsible in any way for injury to any guest and/or their invitees that is caused or permitted to be caused by the intentional or unintentional acts of said guest(s) and/or invitees, or by the failure of structures, appliances, (including hot tubs and bbqs) furnishings, and/or other equipment, whether by malfunction, misuse, acts of god/nature, and/or are otherwise naturally occurring. No guarantees are expressed nor implied as to the suitability of utilities and other services provided to the vacation properties and adjacent structures and premises. No guarantees are expressed nor implied regarding the suitability/compatibility of materials utilized in the construction of the vacation property and/or its contents. and its property owners shall not be held liable nor otherwise responsible in any way for allergic reactions to guest(s) or invitees, caused or permitted to be caused by materials utilized in the manufacture of the vacation property and/or its contents, nor from mold and/or airborne spores, nor from pet/animal allergens, nor from chemical agents including, but not limited to appliances, linens, carpeting, utensils, fixtures, hot tubs, and/or other equipment. By written or electronic endorsement of this agreement, guest(s) and invitees hereby agree to forever hold-harmless and indemnify and its property owners from and against all claims, demands, loss, liability/responsibility of any kind and character, including cost of defense, arising out of or in any way connected with the guest(s) and/or invitees use of the property.

 

11. Additional Terms and Conditions

The undersigned Guest, for himself/herself, his/her heirs, assignors, executors, and administrators, fully releases and discharges Owner from any and all liabilities, claims, demands, and causes of action by reason of any injury, loss of damage by whatever nature which has or have occurred, or may occur to the undersigned, or any of his/her guests as a result, or in connection with the occupancy of the premises and agrees to hold Owner free and harmless of any claim or suit arising there from. In any action concerning the rights, duties or liabilities of the parties to this agreement, their principals, agents, successors or assignees the prevailing party shall be entitled to recover any reasonable attorney’s fees and costs. You also agree to be responsible for and reimburse the property Owner for any applicable costs and attorney’s fees incurred for collection of damage. Neither nor the Owner will be responsible for accidents or injury to guest or loss of money or valuables of any kind. Owner reserves the right to terminate this Agreement upon their discretion at any time.

Agreement shall be enforced under the laws of the State of Alabama, including any applicable rental acts of that state, and represents the entire Agreement. Any amendments must be in writing and signed by both parties. In the event of a dispute, legal action may only be instituted in Baldwin County, Alabama.  If any part of this Agreement shall be deemed unenforceable by law, that part shall be omitted from this Agreement without affecting the remaining Agreement. Owner shall conduct all brokerage activities in regard to this Agreement without respect to the race, color, religion, sex, national origin, handicap, or familial status of any Guest.
